RESUMEN Muchos de los aspectos del funcionamiento cotidiano de las organizaciones que participan en el sistema de justicia penal permanecen aún ocultos y sin explicación. A la manera de una “caja negra”, la mayoría de los estudios dedicados al desempeño de estas instituciones se han centrado casi exclusivamente en las “entradas” y/o “salidas”, sin tener en cuenta su funcionamiento interno. De esta manera, si bien se conoce el estado de ineficiencia y debilidad de estas organizaciones, se sabe poco o casi nada sobre el funcionamiento cotidiano que subyace a dicho estado. La presente tesis estudia el funcionamiento de una organización que participa en el sistema de justicia penal, específicamente en materia de atención y representación legal de las víctimas de delito: la Fiscalía para la Atención Integral a Víctimas del estado de Morelos (FAIV). Esta tesis parte de la afirmación central de que la explicación del funcionamiento de una organización sólo se logra mediante la revelación de los mecanismos que dirigen sus procesos en tanto sistema. En consecuencia, esta tesis es también una crítica a aquellos estudios dedicados casi exclusivamente a generar información estadística sobre este tipo de organizaciones y a la tendencia de estudiarlas “desde fuera”. El objetivo general consistió en analizar el o los mecanismos principales que regulan el funcionamiento de la FAIV, es decir, aquél que juega un papel fundamental para que el sistema se mantenga y funcione de la manera como lo hace. Se tomó como principal referente teórico la perspectiva del Análisis Estratégico (AE) pues su propósito es descubrir los mecanismos que regulan los sistemas humanos. Básicamente, esta propuesta teórica analiza la estructuración de los sistemas humanos que coordina las acciones de sus participantes mediante mecanismos de regulación que, a su vez, articulan los juegos organizacionales y que mantienen en operación al sistema: A esto se le conoce como el modelo del Sistema de Acción Concreto. Se estableció como diseño de investigación el estudio de caso simple de corte cualitativo. El principal hallazgo del estudio consistió en descubrir que el mecanismo de regulación más importante para el funcionamiento cotidiano de la FAIV, en tanto Sistema de Acción Concreto, consiste en una centralización institucional basada en la “autoridad excesiva” y en los intereses y poderes ajenos a la función formal de la organización.

ABSTRACT Many aspects of the day-to-day functioning of organizations involved in the criminal justice system remain hidden and unexplained. In the manner of a "black box", most of the studies dedicated to the performance of these organizations have 5 focused exclusively on "inputs" and/or "outputs", regardless of their internal functioning. Thus, while the state of inefficiency and weakness of these organizations is known, almost nothing is known about the day-to-day functioning that supports that state. This thesis studies the functioning of an organization that participates in the criminal justice system, specifically in the area of legal assistance and representation of victims of crime: the Fiscalía para la Atención Integral a Víctimas del estado de Morelos (FAIV). This thesis is based on the assumption that the explanation of the functioning of an organization is achieved by revealing the mechanisms that regulate its processes as a system. Consequently, this thesis is also a criticism of those studies dedicated exclusively to generating statistical information about these types of organizations and of the tendency to study them "externally". The purpose was to analyze the principal mechanism that regulates the functioning of FAIV, more precisely, the one that plays a fundamental role in the way the system is maintained and functions. The main theoretical reference was the Strategic Analysis (SA) perspective, because its intent is to uncover the mechanisms that regulate human systems. Fundamentally, this theoretical approach analyzes the structuring of human systems that coordinates the actions of its participants through regulatory mechanisms that, in turn, articulate the organizational games that keep the system in operation: This is known as the Concrete Action System concept. A simple qualitative case study was established as the research design. The main conclusion of the study was that the most important regulatory mechanism for the daily functioning of FAIV, as a concrete action system, is related to an institutional centralisation based on 'excessive authority' and on interests beyond the formal function of the organisation.
