Análisis del derecho humano de la seguridad social desde el convenio bilateral vigente entre México y España

El presente artículo analiza el Convenio de Seguridad Social celebrado entre México y el Reino de España de 1994 desde la perspectiva de la seguridad social como derecho humano. En ese sentido, se divide en 5 apartados: el primero precisa la manera en la cual se materializa la seguridad social como derecho humano en México; el segundo presenta un esbozo de la relación bilateral de México y España a través de sus convenios bilaterales; en el tercero y cuarto se analizan propiamente el convenio bilateral: los regímenes y tipos de relaciones laborales a las cuales les aplica lo pactado, así como las prestaciones y su materialización. Por último, el quinto apartado contribuye a la reflexión de la importancia de este convenio -como parte del Derecho Internacional de la Seguridad Social- para la justiciabilidad de la seguridad social como derecho humano.

The article analyzes the Social Security Agreement between Mexico and the Kingdom of Spain of 1994 from the perspective of social security as a human right. In this sense, it is divided into 5 sections: The first one specifies the way in which social security is materialized as a human right in Mexico; the second presents an outline of the bilateral relationship between Mexico and Spain through their bilateral agreements; In the third and fourth, the bilateral agreement is properly analyzed: the regimes and types of labor relations to which the agreement applies, as well as benefits and their materialization. Finally, the fifth section contributes to reflecting on the importance of this agreement -as part of International Social Security Law- for the justiciability of social security as a human right.
